Golden Ticket rules

Article 1. ORGANIZATION OF THE GAME

The company HEALTH & HAPPINESS FRANCE registered with the Nanterre Trade and Companies Register under number 612 030 767, whose registered office is located at 105 rue Anatole France 92300 LEVALLOIS PERRET (hereinafter " the Organizer "), is organizing from 04/14/2025 until 12/21/2025, Central European Time (hereinafter " Duration of the Game ") a game with purchase obligation called: "Variety Anniversary" (hereinafter the " Game ").

This Game is accessible at the following Internet address: https://www.biostime-nosmarques.com/pages/golden-ticket-good-gout (hereinafter referred to as “the Site”).

These Rules (hereinafter the “ Rules ”) define the legal rules applicable to this Game. Participation in the Game implies unreserved acceptance of the Rules in their entirety, as well as the laws, regulations, and other texts applicable in France.

Article 2. CONDITIONS OF PARTICIPATION

This Game is open to any adult natural person residing in Metropolitan France, Corsica, Monaco, Germany, the Netherlands, Belgium, Luxembourg, Italy, Portugal, Spain, Denmark, Austria, excluding members of the Organizer's staff and their families, including cohabitants, and generally companies participating in the implementation of this Game directly or indirectly (hereinafter referred to individually as the " Participant " and collectively as the " Participants ").

 Article 3. TERMS OF PARTICIPATION

 To participate in the Game, the Participant must purchase a pack of Good Goût Variety fruit product. Purchasing this product between April 14, 2025 and December 21, 2025 may earn them a Golden Ticket.

 15 (fifteen) Golden Tickets can be found among the Variety gourd pack from the Good Goût brand which are sold:

• In Carrefour stores located in mainland France;

• On our website https://www.biostime-nosmarques.com/ for deliveries to mainland France, Corsica, Monaco, Germany, the Netherlands, Belgium and Luxembourg, Italy, Portugal, Spain, Denmark and Austria.

 Each Golden Ticket contains a 4 (four) character winning code and a QR Code. The winning Participant (hereinafter referred to as the “Winner”) must declare themselves as the winner by scanning the QR Code on the Golden Ticket using their smartphone within one month of purchasing the product.

 By scanning the QR Code, the Winner will be redirected to the dedicated Contest webpage, where they can view the full rules and access the form. The Winner must complete this form with their full contact details and any other information necessary to receive their Prize, including proof of purchase.

Therefore, Winners are advised to ensure the validity of this information. Any false or erroneous and/or incomplete declaration will automatically result in the cancellation of participation and the awarding of the Prize.

The Organizer reserves the right to carry out any necessary verification.

Each Participant can only win once, regardless of the number of products purchased. In other words, even if a Participant purchases multiple products and obtains multiple tickets, they will only be able to win one prize.

Article 4. DESIGNATION OF WINNERS

Participants who have found a Golden Ticket must report it in accordance with the terms and conditions set out in Article 3 of these Rules. The Winner will be contacted by email to provide proof of purchase and a photo of the Golden Ticket highlighting the 4 (four) digit number on the Golden Ticket.

After verification of the elements provided, the Winner will receive an email containing a promotional code to use on the Site as well as the terms and conditions for using it.

Article 5. THE LOT

The Game allows 15 (fifteen) valid winners to each receive the following Prize:

A promotional code worth 70 (seventy) euros, usable 12 (twelve) times, on the site https://www.biostime-nosmarques.com/ for 1 (one) year from receipt.

Each use of the promotional code allows you to benefit from a maximum discount of €70 (seventy euros) per order. If this amount is not fully used during an order, the remaining balance will not be carried over to the next promotional code.

[AD1] [CF2] The total value of the Student Lot is 840 (eight hundred and forty) euros, corresponding to the average consumer basket of Good Goût gourds over a year.

This voucher will be exclusively valid for the following Good Goût product categories: fruit pouches, breakfast pouches and brewed pouches, excluding promotional offers.

Winner's orders will be subject to our shipping policy available at: https://www.biostime-nosmarques.com/policies/shipping-policy .

The Prize offered is strictly nominative and therefore cannot be transferred to another person. There will be only one Prize per household, the household being determined by all the people living under the same roof.

Any additional details and practical information for the delivery of the Prize will be given to the Winner in due course. The Prize will be sent to the winner at the address provided by the winner.

Any Participant who does not declare themselves as a Winner before the closing of the Game scheduled for 12/21/2025 in accordance with the terms and conditions indicated in these Rules will not be able to benefit from their Prize. The Prize will be considered abandoned by the Winner. The Organizer may then dispose of it freely.

In the event that the Winner does not wish or cannot, for any reason whatsoever, benefit from all or part of the Prize won, under the conditions described in these Rules, he/she loses the full benefit of said Prize and cannot claim any compensation or consideration.

The Prize offered cannot give rise, on the part of the Winner, to any dispute of any kind nor to the delivery of its countervalue in any form whatsoever, nor to its replacement or exchange for any reason whatsoever.

Furthermore, the Organizer reserves the right to substitute, in the event of unavailability, at any time, the Prize offered, a prize of equivalent or greater value or similar characteristics, without any possible dispute on the part of the Winners.

Without prejudice to any legal action and its right to terminate the Winner's registration, the Organizer is not required to send any Prize to the Winner if the latter has not correctly entered his or her contact details when participating or has not complied with these Rules.

Article 6. PROTECTION OF PERSONAL DATA

The Organizer collects and processes the personal data (surname, first name, email address) communicated to it by the Winners for the purposes of, on the one hand, executing and monitoring the Game, and on the other hand, awarding and delivering the Prize subject to the consent of the Winners. In accordance with the regulations in force, in particular Regulation No. 2016/679 (GDPR) of April 27, 2016, all personal data concerning the Winners are processed in such a way as to guarantee the security, integrity and strict confidentiality of said data.

The Organizer, whose information appears in Article 1 of these Rules, is the sole data controller. As such, any processing of personal data carried out within the framework of the Game is carried out under the responsibility of the Organizer. They will be kept by the Organizer for the duration necessary for the purposes of processing said data, in a secure and confidential manner. No transfer of personal data outside the European Economic Area will be made.

The Winners have the right to access, oppose, rectify, limit, port and delete data and information concerning them by simply sending a request to the data protection officer at the following email address: eu_dpo@hh.global. The Organizer may ask you for a copy of your valid identity card or passport, front and back, in order to prove your identity. It will have one (1) month from receipt of your email to respond, except in the event of an abusive or erroneous request. If necessary, you have the right to file a complaint with the CNIL

Article 7. RESPONSIBILITY & MODIFICATIONS

As the Game is held in Carrefour stores, Carrefour will not be held liable in any dispute relating to the Game. Carrefour is neither the organizer nor the sponsor of the operation.

Participation in the Game implies knowledge and acceptance of the characteristics and limitations of the technologies used by the Internet and related technologies, in particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses circulating on the network. It is expressly recalled that the Internet is not a secure network.

The Organizer cannot be held responsible for the malfunction of the Game pages and the QR code. The Organizer does not guarantee that the Game Pages will operate without interruption or that they do not contain any computer errors, nor that any defects observed will be corrected. In the event of a technical malfunction of the Game, the Organizer reserves the right, if necessary, to invalidate and/or cancel the Game session during which the said malfunction occurred. No claims will be accepted in this regard.

The Organizer cannot be held responsible if a Winner's data does not reach it for any reason for which it cannot be held responsible (for example, an Internet connection problem due to any reason on the part of the user, a temporary failure of our servers for any reason, etc.) or if it arrives illegible or impossible to process (for example, if the Winner has inadequate computer hardware or software environment for their registration, etc.).

The Organizer cannot be held responsible for any damage of any nature (direct, indirect, material or immaterial) occurring during the participation of a Participant in the Game.

It is the responsibility of each Winner to take all appropriate measures to protect their own data and/or software stored on their computer equipment from any damage. Any person connecting to the Game pages, using the QR code and participating in the Game is entirely their responsibility.

The Organizer reserves the right to use any recourse and in particular to exclude or prosecute anyone who has cheated, defrauded, rigged or disrupted the operations described in these Rules, or has attempted to do so.

The Organizer reserves the right to make any changes to the Game and the Rules at any time, without prior notice or obligation to provide reasons for its decision and without incurring any liability as a result. In particular, it may shorten, suspend, extend or cancel this Game, in part or in its entirety, if circumstances so require and without the Participants and/or winners being entitled to claim any compensation in this regard.

Any modification to the Regulations will come into force as soon as it is posted online and will be notified by all appropriate means, in particular on the Site.

The Organizer's liability is limited to the maximum total amount of the Prize at stake.

Article 8. INTELLECTUAL PROPERTY RIGHTS

All trademarks, logos and other distinctive signs reproduced on the Game Pages as well as on the sites to which it allows access via hypertext links, are the exclusive property of their owners and are protected as such by the provisions of the Intellectual Property Code. Any unauthorized reproduction of these trademarks, logos and signs constitutes an infringement punishable by criminal penalties.

All software used on the Game Pages and those to which it allows access, as well as the texts, illustrations or images reproduced on the Pages and on those to which it allows access, are subject to copyright, and their unauthorized reproduction constitutes an infringement punishable by criminal sanctions.

Article 9. CONSULTATION OF THE REGULATIONS

These Regulations can be obtained free of charge by simply consulting the Site.

Article 10. APPLICABLE LAW, INTERPRETATION AND DISPUTES

The Rules are governed exclusively by French law. Any question of interpretation or application of the Rules shall be decided by the Organizer.

Any dispute or claim relating to this Game must be made by simple letter addressed to the Game Organizer whose contact details appear in Article 1 hereof and before 21/12/2025, the postmark being proof. This letter must indicate the precise date of participation in the Game, the full contact details of the Winner and the exact reason for the dispute. No other method of dispute or claim may be considered.

In the event of a persistent disagreement relating to the application and/or interpretation of these Rules, and in the absence of an amicable agreement, any dispute will be submitted to the competent jurisdiction of the Winner's place of residence.

If one or more provisions of these Regulations were declared null or inapplicable, the other clauses would retain their full force and scope.
